Successful constitutional complaint against an extradition to Romania. The court set aside the decision of the Higher Regional Court of Schleswig-Holstein and remitted the case, holding that the lower court had not sufficiently examined the concrete detention conditions awaiting the complainant.

Successful constitutional complaint: the court found a violation of Article 4 of the EU Charter of Fundamental Rights and set aside the extradition decision of the Higher Regional Court of Schleswig-Holstein. The lower court had not sufficiently examined the detention conditions in the destination facility — in particular, an overall assessment of cell size and out-of-cell time was missing. The court had already halted the surrender by interim injunction of 24 July 2020.

Successful chamber decision concerning an extradition to the Russian Federation: the court set aside the admissibility decision of the Higher Regional Court of Schleswig-Holstein and remitted the case. It criticized the insufficient judicial examination of the bar to extradition arising from political persecution, and the failure to take into account refugee status granted in another EU member state.

Two interim injunctions against an extradition to the Russian Federation for the purpose of prosecution: the court first stopped the surrender by decision of 24 June 2019. After the Higher Regional Court had decided anew, Karlsruhe prohibited the surrender a second time by decision of 22 November 2019 — until the Higher Regional Court finally declared the extradition inadmissible. The court objected to the insufficient examination of the right to effective legal protection and the inadequate treatment of the bar to extradition arising from political persecution.

Successful chamber decision in extradition proceedings concerning Romania. The court first prohibited the surrender by interim injunction and then upheld the constitutional complaint. The decision of the Higher Regional Court of Schleswig-Holstein was set aside because the court had not sufficiently examined the detention conditions and had failed to refer the matter to the European Court of Justice.
